Intuitive Surgical’s third-quarter sales rose 22% to $3.05 billion, but reported net income declined as it booked a large antitrust-litigation settlement charge. The contrast is important: higher surgical-system activity did not translate into higher GAAP profit for the quarter.

The company’s October 20 earnings announcement reported net income attributable to Intuitive of $523 million, compared with $704 million a year earlier. Non-GAAP net income instead increased to $1.05 billion from $867 million, reflecting a different treatment of specified costs.

Sales and the settlement charge

Measure Disclosed result Primary source
Q3 revenue $3.05 billion; +22% year-on-year Official results
GAAP attributable net income / diluted EPS $523 million / $1.49; prior year $704 million / $1.95 Official results
Non-GAAP attributable net income / diluted EPS $1.05 billion / $3.00; prior year $867 million / $2.40 Official results
Litigation settlement charge $450 million before tax; $347 million after tax Official results
Settlement status Written agreement; preliminary and final court approval remain pending Official results
Worldwide procedure growth About 15% combined; da Vinci 14%, Ion 31% Official results

The settlement was reached without an admission of liability or wrongdoing. Court approval is not complete, so the agreement must not be described as finally approved. The expense has nevertheless been recognised in the third-quarter accounts, which is why the accounting event and the legal completion date need separate descriptions.

Why the two profit figures point in different directions

GAAP profit follows standard US accounting rules and includes the recorded settlement expense. The company’s non-GAAP calculation excludes specified items, including that charge. Neither figure is a substitute for the other: one shows the reported earnings outcome and the other is management’s adjusted comparison.

Both GAAP and non-GAAP net income also included a $22 million after-tax benefit from refunds of previously paid tariffs. An adjusted label therefore does not mean every unusual benefit has disappeared from the figure. The detailed reconciliation remains necessary.

For subsequent quarters, readers can watch procedure activity and placements alongside the settlement process. A system placement is not automatically an outright cash sale because leasing arrangements can be involved. This report does not establish patient outcomes, clinical superiority or investment returns from the revenue figures.
